Warranty
Video Conversion, Replication and Duplication Warranty: For 90 days after shipment, eVideo Solutions will evaluate any faulty disc or claim that any VCD, SVCD, DVD, or other custom conversion was performed improperly. At our discretion, we may replace the disc or perform the conversion again. Both original source material and faulty VCD, SVCD, DVD, CD-R, or DVD-R media must be returned to eVideo Solutions for analysis and evaluation. This Warranty shall not apply to any damage or loss by misuse, accident, mishandling, or any treatment under improper conditions.
eVideo Solutions does not warrant that our DVD or CD recordable media, or encoded audio or video formats will playback properly on your specific systems. THE FOREGOING WARRANTIES ARE THE ONLY WARRANTIES PROVIDED BY eVideo Solutions AND THIRD PARTIES WHO CONTRIBUTE TO THE SERVICE AND ARE IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES WITH REGARD TO THE SERVICES TO BE PROVIDED UNDER THIS AGREEMENT, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NONINFRINGEMENT, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, REPRESENTATIONS, OR ENDORSEMENTS REGARDING THE SERVICE, THE SOFTWARE, OR ANY THIRD PARTY MATERIAL AVAILABLE THROUGH THE SERVICE. THE SERVICE AND ANY SOFTWARE ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS -- WE DO NOT WARRANT THAT THEY WILL BE ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. IN NO EVENT SHALL eVideo Solutions BE LIABLE FOR INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. eVideo Solutions'S ENTIRE LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT (INCLUDING BREACH OF WARRANTY), OR IN TORT (INCLUDING NEGLIGENCE), SHALL BE LIMITED TO THE TOTAL AMOUNT OF THE APPROPRIATE ORDER.
Web Services Warranty: eVideo Solutions warrants that commencing from the date of acceptance by the Client and continuing for a period of ninety (90) days that the website and software substantially conforms to the Specification and the Scope of Works and is substantially suitable for the purposes for which it was designed. The terms of the Warranty are that during this period any errors or omissions will be rectified by eVideo Solutions at no cost to the Client. The Warranty does not apply if the website and software has not been operated in accordance with the instructions given by eVideo Solutions.
eVideo Solutions makes no warranty that the website and software is totally error free or that the Client will be able to operate the website and software without any problems or interruptions caused by unforeseen problems or untested scenarios.
eVideo Solutions makes no further warranties of any kind, whether express or implied, for the services it provides. eVideo Solutions also disclaims any warranty of merchantability or fitness for any particular purpose other than that covered by the 90 day Warranty.
Due to the continual development of new techniques for intruding upon and attacking Internet based systems, eVideo Solutions cannot warrant that the Software or any equipment, system or network on which the Software is used will be free of vulnerability to intrusion or attack. No liability will be accepted for the loss, corruption or theft of personal or financial information caused by deliberate and malicious intrusion or attack.
eVideo Solutions will not be responsible for any direct, indirect or consequential damages that may result from the use of its services, including loss of data resulting from delays, non-delivery or interruption in service. You acknowledge and agree that eVideo Solutions cannot guarantee the absence of service interruptions caused by Acts of God or other circumstances beyond our control.
eVideo Solutions will provide telephone and email support for services we provide to you during normal office hours. Outwith these times support by email only is available with a 24 hour response.
Problems with the operating system and software on your own computer and your Internet connection are specifically excluded from this agreement.
